    I personally don't have or use an overdraft so, it doesn't affect me.

    i think it stinks . what gives the banks the right to charge you 35 quid if ur a penny overdrawn ...and 25 quid for sending you a letter a bout it ,,i hope people stop banking with the banks i really do and i hope they appeael this decision i hate banks ive had it done to me ..ok sumtimes u cant help going overdrawn ,things happen in life u have no control over so y shud the banks make money outta you ...if it wasnt for us te banks wudnt exist

    They going political over this and it not over yet, judge told OFT to nose around regulation 5 not 6, it all suss poss by recession? we know banks got no money.

    Just remember when credit card companys were told by OFT to reduce their charges from £24 to £12 because they were deemed as excessive, half of these companys ARE banks,,,, SO whats the difference?

    little update, with the test case in mind, it ONLY covered s6 of the unfair consumer regs, I am now attempting legal action against Santander under section 5, the reason for this the is an account (abby) that was O/D by 1300 odd and was disputed as over 2k in charges on it, they have apparently now taken 800 from 1 account and put it in STILL disputed account, i know they can do this as it in T's & C's but as said it still in dispute.
    the person involed has now been defaulted on the account (still in dispute),
    by doing this they have breached s13.6 of the banking code ( registering info with credit ref) and have breached the Data Protection Act.

    They way I am going is untried and untested but it does stand a good chance, will go through the courts to get charges refunded and the 800 put back.
    IF i am sucessful i will that take them to court for a 2nd time for damages and compensation under section 13 of the data protection act.

    if any one is interested just sub to thread and i'll keep it updated, Court action will be started by end of feb and I am quietly confident of a good outcome. :)
