Right....to cut a long story short, I am selling my Dads house, the sale is going through as we type, we needed what they call a HIP ( home information pack) on it and it was gonna cost £364 upfront or for it to be deferred £80 on top of that, so we deferred it, til the house was sold, or so we thought!
Received a letter this morning demanding the HIP payment of £463 and they r taking it from my account on 1st december...
Apparently they defer it for only 9months, but reading my agreement theres nothing that states that...
I have signed this agreement and been through it with a fine tooth comb, rang them told them this and they r still gonna take payment, wghich will not be in my bank so i will be charged £35....
I am having to take out an overdraft to see this payment right and i dont think this is legal and fair?????????????????????
My agreement is proof so what can I do?

Jacs, you may need to seek some further advice regarding this. A quick search in google shows lots of information on HIP's.

That implies that the money can be deffered till after the sale of the property. However, seek information from perhaps CABWhat about sellers who cannot afford the up-front costs?
It should be possible to defer payment of all, or some of the costs until the property is sold, as happens with estate agents' fees in many places.
i was gonna suggest contacting your local CAB office as i dont really know much about properties etc. keep us up dated on the situation and hope u sort it

cab waste of time. IF it does DEFFINITLY does NOT state a time limit on the agreement then it's a no brainer. dont worry bout over draft hun. all you need to is let them take it on the 1st (check to see if they taken it) then ring bank up and squeek like hell coz you didnt authorise it to be taken out, the bank has no choice BUT to recall it. bring up about the charge you will get for going over the limit and yet again POINT out that you did NOT authorise for the money to be taken out and you not liable for any charges incurred.
are u able to scan/photo the whole agreement and e-mail it to me? if so plz do fairly quickly.

My last case was against barclays earlier on this year, the muppets decided to call my bluff and unlucky for them I won a CCJ against them :D

I know you can't sell a house without an information pack. I would contact your Local CAB office on Monday for advice. My work is closely linked to an Estate Agent so I would have thought that the Solicitor or Estate Agent handling the sale should have sorted this for you?

I have been to the estate agent this am and they have a different copy which i signed, different to the one i got, the 9months is on there so i guess i have to pay...Its a nightmare.
I do know i have no choice in having a HIP, just thought (cos nothing was said to me) that would be charged when house is sold, its looking like my copy means nothing.
